Why make a Lasting Power of Attorney?

If you become incapable of managing your own financial affairs then someone has to step in and manage them for you. If you have not already made a Lasting Power of Attorney (LPA) appointing a person/people to do this (your Attorney(s)) then someone - perhaps not the person you would have chosen, has to apply to the Court of Protection for the authority to do this (called a Deputy).
If you do not have an LPA, the alternative is applying to the Court of Protection. This is a complicated and slow process and usually more expensive than the costs of making and registering an LPA whilst you are able to. Save your family this hassle by making an LPA now.

If you make a Lasting Power of Attorney while you can
- YOU get to choose who has this responsibility (your Attorney(s)) rather than the Court.
- YOU can also choose reserve attorneys.
- YOU can give guidance about how you would like your affairs to be managed.
- An LPA can also be used to help YOU even when you are still mentally capable of running your affairs, but perhaps have a deteriorating physical condition that makes it difficult to deal with everything as easily as you would like or maybe even to sign your name.
